Terms of Service:

For the sake of simplicity and consistency, these Terms of Service apply to all of iPhone Theme members, including those who download iPhone Themes offerings, those who purchase iPhone Theme with an Online Web account whether it’s through iPhone Theme website or through iPhone Themes mobile website.  iPhone Theme is exclusively only available through iPhone theme for pocket pc dot com, any other site providing this offering is in violation.  Accordingly, there are some provisions below relating to the use of iPhone Theme offerings which necessarily apply only to those of iPhone Theme members who plan to download the iPhone Theme. All other terms and provisions apply to all of iPhone Theme customers and members who plan on purchasing the iPhone Theme.

Important—Read carefully: These Terms of Service for all iPhone Theme installation software, Site and Services (these "Terms of Service") together constitute a legal agreement between you (an individual, not an entity) and iPhone Theme. By clicking on the "Buy Now" button or otherwise using or accepting to purchase the Software / membership of iPhone Theme, Site and/or Services (the "iPhone Theme Offerings"), you agree to be bound by the terms of these Terms of Service. If you do not agree to these terms of service, do not click on the "Accept" button and do not purchase the Software, Site or Services. You agree that your use of the Software, Site and/or Services acknowledges that you have read these Terms of Service, understand them, and agree to be bound by these Terms of Service.

The iPhone Theme Offerings provided to you under these Terms of Service is (A) for the Complete Version, for your personal and non-commercial use only and for any Premium Version, for your personal and your commercial use (other than in connection with a service bureau, application service provider, or similar business).

1. Description of Services 
iPhone Theme provides you with the capability of updating, maintaining, and accessing your iPhone Theme offerings though the iPhone Theme membership that includes downloads of the iPhone Theme and add-on modules.  The iPhone Theme is a collection of custom Theme wrappers that make a graphical wrapping around third party software.  The third party software is not a product of iPhone theme but as an optional source for downloads of the software themes provided by iPhone Theme.  All third party software registration and purchasing is not included with the iPhone Theme purchase. (i) As stated in the iPhone Theme requirements, the software WisBar Advance and WisBar Advance Desktop registration codes and activation is not included in the iPhone Theme offerings.

2. Back-Up
Back-up.  You are advised to back-up your phone before downloading and installing the iPhone theme, the Wisbar software, and any third-party add-on.  
3. Liability. 
We are not responsible for your loss of data, corruption and/or malfunction of your device caused by installing any and all third party software.  This includes all Add-on Modules and Lakeridge software applications.  We only support the "iPhone Theme" for Wisbar Advance and WisBar Advance Desktop.
By downloading and installing ours, or any of the add-on module third party software provided by us or third party developers, you agree to our Terms of Service and agree to not hold iPhone Theme responsible for any damages, malfunctions, or loss of data.

We advise you to do a complete backup your device in case of malfunction or loss of data before installing any software applications.

2. Requirements
You are responsible for making sure that your phone has the required specifications to run the software.
You must have the following requirements to properly run the iPhone theme software:
a) Windows Mobile 2003, Windows 5.0, or Windows 6.0
b) Touch-screen enabled phone.
c) WisBar Advance 
WisBar software must be purchased from LakridgeSoftware.com and be registered to you as the user.
d) WisBar Advance Desktop
Wisbar software must be purchased from LakridgeSoftware.com and be registered to you as the user.
e) QVGA, VGA, or SQVGA screen resolution

3. Wisbar Software
a) If not currently owned, you'll need to purchase the Wisbar Advance and Wisbar Desktop from the developer at LakeridgeSoftware.com. The WisBar software is not included in the price of our iPhone theme.
b) WisBar software will require a registration code provided after purchase of the WisBar software at LakeridgeSoftware.com.

4. Customer Support
a) iPhone theme for Pocket PC dot com provides customer service via email and is limited to our iPhone theme software.  
Limitations of Support. We do not support WisBar Advance, WisBar Desktop, or third party add-on modules.
Support Liability. We are not liable for any problems that arise and advise a back-up before installation of the iPhone theme and the installation of any add-ons.

5. Personal License 
iPhone Theme hereby grants you a non-exclusive, non-transferable license to use the iPhone Theme's and to use and to access the Site and Services subject to the terms and conditions in these Terms of Service. Under this license you may only: (i) use a purchased Version for your personal and non-commercial use; and (iii) make one copy of the Software in machine readable form solely for back-up purposes, provided that you reproduce all proprietary notices on the copy.
 
6. Refunds
Due to limitations with electronic media we do not offer refunds for errors due to phone compatibility, "changing your mind", software malfunction, or loss of use.

7. iPhone Theme's Right to Terminate or Modify Terms of Service and Services 
iPhone Theme may modify these Terms of Service upon notice to you at any time. These modifications may include, without limitation, charging for any features within the iPhone Theme membership Offerings. iPhone Theme may provide notice to you of any such modification by e-mail or by publishing the changes on its Web site. In the event iPhone Theme modifies these Terms of Service, you may terminate your use of the iPhone Theme Offerings. iPhone Theme may also terminate your right to use the iPhone Theme membership Offerings at any time for any reason. Without limiting the prior sentence, your right to use the iPhone Theme membership Offerings will automatically terminate if you fail to comply with any term or provision of these Terms of Service. No notice shall be required from iPhone Theme to effect such an automatic termination. Upon any termination of your right to use the iPhone Theme Offerings, you shall immediately discontinue use of the iPhone Theme Offerings.

6. Limitation of Liability 
To the maximum extent permitted by applicable law, in no event shall iPhone Theme or its suppliers be liable for any consequential, incidental, indirect, special, punitive, or other damages whatsoever or for damages for loss of business profits, business interruption, computer failure, loss of business information, or other pecuniary loss arising out of these Terms of Service or the use of or inability to use the iPhone Theme Offerings, even if iPhone Theme has been advised of the possibility of such damages. Your sole and exclusive remedy for any dispute with iPhone Theme related to these Terms of Service or the iPhone Theme Offerings shall be cancellation of the License and termination of use of the services. In the event a court awards direct damages despite the foregoing, such damages shall not exceed the amount you paid for the software and services. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

Affiliate Program

We offer to all affiliates permission to link into our site from theirs. We will give a 20% commission of all purchases that originated from your website into ours.
